At FLP, we recommend a prenup or postnup agreement for:

Second Relationships

You have been married before and have exisiting assets and liabilites from a previous relationship and want to avoid the financial and emotional pain of another journey through the family court system.

Blended Families

You have children from a previous relationship and want to ensure their future inheritance is protected. The last thing you want is your  children fighting with your new spouse about your assets now or in the future.
‍

Significant Assets

You are entering a relationship with significant wealth, a business, or expected inheritance that you want to ring-fence from future disputes.

The certainty you need, with fees guaranteed.

Most financial agreements are intimidating, with unknown fees and confusing legal jargon. We simplify the process with a clear scope of works, fixed fees and plain-english enforceable agreements.

Fixed fees. No billable hours.

We provide a fixed price for prenups and postnups.

100% confidential & court free.

These agreements do not require family court approval to be valid.

Binding & enforceable protection.

We draft strong agreements that are enforceable and built to last.

How it works

Get your signed agreement within 30 to 60 days

Consultation and scope of works.

We begin with a confidential consultation to understand your priorities, goals and what matters most to you. Following this, you will receive a taliored scope of works and clear, fixed-fee proposal, giving you complete visibility over costs, process and timeframes.

Draft, review, refine.

We prepare your agreement consistent with your priorities, that protect your interests, address your unique circumstances, and ensure every essential term is accurately captured and legally enforceable. You and your partner will receive independent legal advice with the opportunity to review, negotiate and refine the agreement, until it is completed with precision.

Signed and finalised within as little as 30 days.

Once terms are agreed, we manage the signing process, ensuring your agreement is legally binding. You will recieve your finalised agreement for safe keeping. And we remain available, if necessary, to review, and update it over time, ensuring it continues to reflect your evolving relationship and financial circumstances.

Thank you again for today. You have achieved more in the last 72 hours than my previous lawyer did in 2 years.

Thank you so much for all of your advice and work to bring my settlement to a close. I came to you very scared and in a weak position after receiving so much bad advice. I am so grateful for the high level of knowledge and skill that you brought to the table to resolve my matter.

I cannot tell you how grateful I am to have you looking after my case. Upon reading the letter you wrote to the other side, tears filled my eyes as to the relief it gave me to have someone like you support me in such a manner.
S. Brisbane
Thank you, Joe, for levelling the playing field with my husband and his aggressive lawyers. The hardest time of my life and you helped me keep my chin above water.
E. Brisbane
Thank you for everything you did on Friday, you made me feel relaxed while we worked through the financial and parenting matters. I am glad I walked away from my previous lawyers and found you. It was a great outcome.

Planning ahead is wise, not unromantic.

A prenup or postnup agreement is not about expecting the worst. It is about respecting each other enough to be honest about money, assets, and protecting your children from a previous relationship. That's maturity. That's care. That should be the foundation for all second relationships.

  • You communicate expectations from the start
  • No "separation circus" in court ever again
  • Protect what you have built to date for you and your children

FAQ

Financial Agreements

What happens if someone breaches a Binding Financial Agreement?

If a Binding Financial Agreement is breached, the affected party can seek remedies through the court, including enforcement of the agreement's terms or compensation for the loss caused by the breach.

Is a prenup the same thing as a Binding Financial Agreement (BFA)?

Yes. 'Prenup' is a common name for a Binding Financial Agreement. You'll also hear terms like postnup, cohabitation agreement, or separation agreement, depending on when it's signed and whether you are married or de facto. They all fall under the same legal framework.

Can a prenup cover assets I might acquire in the future?

Yes. A financial agreement can look forward and set rules for how future property, income, inheritances and investments will be treated. This gives you certainty as your financial position evolves over time.

Can a prenup help protect a business in a property settlement?

Yes. A carefully drafted agreement can quarantine your business from the divisible asset pool and set out exactly how it will be treated if the relationship ends. For business owners, this is one of the most important protections you can put in place.

Can a prenup decide parenting arrangements?

No. Under the Family Law Act 1975, Binding Financial Agreements are limited to financial matters. Parenting arrangements have to be handled separately through agreement, a parenting plan, or consent orders.

We understand that when you’re navigating a separation or family law dispute, the financial strain can sometimes stand in the way of accessing the legal support you deserve. That’s why FLP Family Law have partnered with JustFund - Australia’s only dedicated provider of flexible funding solutions for family law legal fees.

Through this partnership, eligible clients can access a flexible line of credit to cover legal fees and expenses related to separation or property matters, with nothing to repay until your settlement is reached.Approval is based on your legal matter, not your income or credit score, making quality legal representation accessible even during times of financial hardship.
